Beta Version Notice
TrustScore v1.0 (Beta): The Finaive TrustScore platform is currently in a beta stage. It is provided on an "as is" basis for preliminary use and evaluation, with no guarantees of final functionality or performance. During this beta period, TrustScore outputs may contain errors, omissions, or incomplete features. Finaive reserves the right to modify, suspend, or withdraw the TrustScore service at any time without notice as development continues. Users should exercise heightened caution and not rely on beta outputs for critical decisions, as the service is still undergoing testing and improvement.
Informational and Probabilistic Nature
Informational Purposes Only: Finaive's TrustScore outputs are provided for general informational purposes only. Each TrustScore represents a probabilistic assessment of risk based on available data, not a definitive statement of fact or a guarantee of any outcome. TrustScores are inherently non-deterministic and subject to uncertainty. They are opinions generated by algorithms applying risk factors, and not a substitute for professional advice, certified reports, or independent verification. No information provided by the TrustScore should be interpreted as absolute truth, conclusive evidence, or a recommendation to take (or refrain from) any action.
Not a Background Check or Verification Service
Finaive does not provide background screening, identity verification, or law enforcement services through the TrustScore. TrustScore is not:
- A Criminal or Credit Background Check: It is not a criminal history report, credit report, or any form of consumer background check, nor is it governed by credit reporting laws. The TrustScore does not access or verify official criminal records, credit files, or other private background information.
- Identity or Credential Verification: It is not an identity authentication service. Submissions of identification, KYC information, or other credentials are not independently verified for TrustScore purposes, and Finaive makes no confirmation of any user's true identity or legal status.
Fraud Detection Certification
It is not a law enforcement tool or fraud investigation report. A TrustScore flagging risk does not mean Finaive has detected or confirmed fraud, and a lack of flags does not certify absence of fraud. Finaive does not determine or declare that any user has engaged in wrongdoing or that any user is "safe."
Official Approval or Endorsement
It is not an accreditation, guarantee, or approval by Finaive of any individual, business, website, or transaction. A high TrustScore must not be understood as Finaive vouching for a user's reliability, and a low TrustScore is not a formal accusation against the user. The TrustScore system operates independently of any government or regulatory background-checking processes, and cannot replace the due diligence and verifications offered by official authorities or licensed services.
Context-Dependent Opinion (No Findings of Fact)
Not Factual Determinations
TrustScores are context-dependent opinions derived from public information and user-submitted data, not proven facts or adjudications. Any risk indicators, flags, or assessments in a TrustScore reflect potential concerns based on patterns and signals; they are merely cautionary opinions, not factual findings of misconduct. In particular, the presence of a risk flag or low TrustScore does not prove that a person or entity has committed fraud, is untrustworthy, or has engaged in any wrongful act. Conversely, the absence of reported risk or a high TrustScore does not guarantee that a person or entity is honest, legitimate, or compliant with all obligations. No TrustScore outcome should be construed as an accusation, verdict, or certification regarding any user's conduct.
Unverified Third-Party Data
Finaive's TrustScore may incorporate data and reports submitted by third parties (including other users) or gathered from public sources. Finaive does not independently verify or guarantee the accuracy, authenticity, or completeness of any third-party data used. User reviews, complaints, or allegations that contribute to a TrustScore are considered personal opinions of the reporting individuals; Finaive does not endorse or adopt those views. TrustScore reports are, by nature, compilations of unverified allegations and publicly available information, not factual determinations by Finaive. In accordance with platform policy, users are solely responsible for the content of their submissions – Finaive is not responsible for user-generated content and the views and allegations expressed in such content belong only to their authors. Finaive provides the TrustScore as an aggregated analytic opinion, and does not assert the truth or falsity of any specific claim or report that may influence a score.
No Guarantee or Surety
Neither a TrustScore nor any badge, rating, or label associated with Finaive's TrustScore platform constitutes a guarantee by Finaive of any party's performance, financial status, or trustworthiness. Finaive is not acting as a guarantor or surety for any user, business, transaction, or website that is rated. The TrustScore is not a promise that any transaction will be successful or risk-free, and it is not an insurance policy against fraud or loss. Likewise, Finaive's provision of a TrustScore does not mean that Finaive is advising, inducing, or encouraging anyone to enter into any transaction with a given user. All TrustScore outputs are contextual indicators intended to guide further inquiry, not definitive judgments.
User Responsibility
User's Due Diligence
Any use of or reliance on the TrustScore is entirely at your own risk. The TrustScore is a supplemental tool and does not replace your own skill, judgment, inquiry, or experience in evaluating the trustworthiness of others. You are solely responsible for any decisions or actions you take when engaging with other users or transactions, whether online or offline, and you should undertake your own independent verification and due diligence in addition to considering the TrustScore's information. Finaive strongly advises that you do not make important decisions (such as sending payments, shipping goods, or entering contracts) based solely on a TrustScore without additional corroborating evidence and personal judgment.
Assumption of Risk
By choosing to view or use TrustScore outputs, you acknowledge and agree that you assume full responsibility for any consequences of your use. Any outcome — whether financial loss, business decision, or other result — that arises from your reliance on a TrustScore is a result of your own judgment and is accepted by you as a risk inherent in using an informational tool. Users remain solely accountable for their decisions, and should a TrustScore be inaccurate, outdated, or incomplete, any resulting action or inaction by the user is at the user's own risk. Finaive does not bear responsibility for how you interpret or act upon a TrustScore, and no claim may be made against Finaive for losses or damages resulting from your use of this voluntary informational service.
Disclaimer of Warranties
"As Is" Service
Finaive provides the TrustScore service "as is", without any warranties of any kind, whether express, implied, or statutory. No warranty or representation is made that the TrustScore (or any related reports or services) will be accurate, complete, current, error-free, reliable, or suitable for any particular purpose. To the fullest extent permitted by law, all implied warranties or conditions (including but not limited to implied warranties of accuracy, completeness, non-infringement, merchantability, and fitness for a particular purpose) are expressly disclaimed. Finaive does not warrant that the TrustScore platform will operate uninterrupted or free of defects, or that any identified issues will be corrected.
No Guarantee of Accuracy or Outcomes
Finaive makes no guarantee or promise regarding the results or outcomes obtained from the TrustScore or the correctness of any risk evaluation. While Finaive strives to use robust methods and data, we do not warrant or ensure that any TrustScore will accurately predict real-world behavior or risk, or that it will align with any third-party assessments. You accept that any TrustScore may be incomplete or imperfect, and that Finaive has not made any warranty or representation that relying on a TrustScore will prevent fraud, financial loss, or any other harm. All information provided via TrustScore is subject to change without notice, and Finaive does not guarantee that the service will always be available, updated, or maintained (especially given its beta status).
Limitation of Liability
No Liability for Use of TrustScore
To the maximum extent permitted under applicable law, Finaive and its affiliates shall not be liable for any loss or damage arising out of or in connection with your use of, reliance on, or inability to use the TrustScore service. This exclusion of liability applies to all forms of damage or loss, whether in contract, tort (including negligence), statutory, or otherwise. Under no circumstances will Finaive (or its directors, officers, employees, partners, or agents) be responsible or liable for any indirect, special, incidental, consequential, exemplary, or punitive damages of any kind. This includes, without limitation, any loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings, or any other intangible losses, even if Finaive has been advised of the possibility of such damages.
Liability Cap and Release
In jurisdictions that do not allow the exclusion of certain warranties or liabilities, Finaive's liability will be limited to the minimum extent permitted by law. In any event, Finaive's total cumulative liability to any user for any claims arising from or relating to the TrustScore is strictly limited; by using the service, you agree that this limitation of liability is reasonable and appropriate given the purely informational and beta nature of the TrustScore. By using Finaive's TrustScore platform, you voluntarily release and hold Finaive harmless from any and all claims, demands, or losses connected to your use of, or reliance upon, any TrustScore output. You further agree to indemnify and defend Finaive from any third-party claims arising out of your misuse of TrustScore information.
No Reliance or Damages
Finaive will not be liable for any decision made or action taken by a user in reliance on a TrustScore, nor for any consequences of false positives or false negatives in TrustScore assessments. Any damages, injuries, or losses (financial or otherwise) that you incur through use of the TrustScore are your own responsibility, and Finaive is not responsible for compensating you or any other party for those outcomes. This disclaimer of liability applies regardless of the legal theory of liability (breach of contract, negligence, strict liability, defamation, or otherwise) and regardless of whether any remedy fails of its essential purpose.
Continued Use Equals Acceptance
Your continued use of the Finaive TrustScore platform constitutes your acknowledgement of and agreement to this Disclaimer. If you do not agree with any part of this Disclaimer or if you are unwilling to assume the risks described, you should refrain from using the TrustScore service. This Disclaimer is intended to be as legally enforceable as possible to protect Finaive from unintended liability, and it shall be interpreted to the fullest extent allowed by governing law in favor of Finaive's limitation of liability and warranty disclaimer. All users are deemed to have read and understood this Disclaimer before using the TrustScore platform.
